Terms of Use

PLEASE READ THESE TERMS OF USE CAREFULLY. These Terms of Use ("Terms", "Agreement", or "Terms of Use") govern your access to and use of the Assyrian Events website, platform, applications, event listings, organization profiles, communications, donation functionality, and related services (collectively, the "Services").

1. PURPOSE OF THE PLATFORM

Assyrian Events is a community information and event-discovery platform. Our primary purpose is to provide a place where users and organizations can discover and share information about events and community activities. Assyrian Events is not generally the organizer, producer, venue, host, sponsor, ticket seller, promoter, or operator of the events listed on the platform. Unless an event is expressly identified as being operated by Assyrian Events, Assyrian Events has no responsibility for the event itself.

2. ACCEPTANCE OF TERMS

By using the Services, you represent that you have the legal capacity to agree to these Terms, or you are using the Services with the involvement and permission of a parent or legal guardian where required by applicable law. If you are not legally capable of agreeing to these Terms, you may not use the Services except as permitted by applicable law and appropriate parental or guardian involvement.

3. CHANGES TO THESE TERMS

We may modify these Terms at any time. Updated Terms will be posted on the website with a revised "Last Updated" date. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

4. EVENT SUBMISSIONS

Users and organizations may submit events for consideration. Submission does not guarantee publication. Assyrian Events may, in its sole discretion and to the extent permitted by law: approve an event, reject an event, edit an event, request additional information, delay publication, remove an event, mark an event as cancelled, mark an event as updated, suspend an organizer, limit submission privileges.

5. ORGANIZER RESPONSIBILITY

The person or organization submitting an event is solely responsible for the event and all related activities. Organizers are responsible for: accuracy of event information, obtaining required permits, obtaining venue authorization, obtaining licenses, insurance, safety, security, compliance with laws, compliance with venue requirements, ticket sales, registration, refunds, event staffing, food and beverage compliance, transportation, accessibility requirements, participant communications, event cancellation, event postponement, event changes, any claims arising from the event. Assyrian Events does not assume these responsibilities by publishing an event.

6. EVENT INFORMATION DISCLAIMER

Event information is provided by organizers, users, or other third parties. We do not guarantee that event information is accurate, complete, current, reliable, lawful, available, safe, or suitable for any particular person. Events can change or be cancelled without notice. Users should confirm important event details directly with the organizer before attending, purchasing tickets, traveling, or otherwise relying on event information.

7. EVENTS ARE THIRD-PARTY ACTIVITIES

You acknowledge that attending an event listed through Assyrian Events is a decision you make independently. To the maximum extent permitted by law, Assyrian Events is not responsible for any injury, illness, death, property damage, theft, loss, accident, criminal activity, negligence, misconduct, dispute, discrimination, harassment, cancellation, postponement, schedule change, venue change, ticket issue, registration issue, refund issue, food-related issue, transportation issue, weather-related issue, security issue, or other incident arising from or relating to an event, organizer, venue, participant, attendee, vendor, sponsor, performer, or other third party.

8. NO ENDORSEMENT

The publication of an event, organization, business, individual, sponsor, venue, or other entity on Assyrian Events does not necessarily mean that Assyrian Events endorses, sponsors, verifies, recommends, or is affiliated with that entity. Unless expressly stated otherwise, users should not interpret a listing as an endorsement.

9. NO GUARANTEE OF EVENT AVAILABILITY

We do not guarantee that an event will occur, that an event will not be cancelled, that tickets will be available, that registration will be available, that an organizer will respond, that the venue will be accessible, that an event will meet expectations, that an event will be safe, or that information will remain unchanged.

10. EVENT CANCELLATIONS AND CHANGES

Organizers should promptly update Assyrian Events regarding material changes. However, Assyrian Events cannot guarantee that changes will be received, reviewed, published, or communicated before a user relies on them. The organizer remains responsible for communicating changes to attendees.

11. TICKETS AND REGISTRATION

Assyrian Events may link users to third-party ticketing or registration services. Unless expressly stated otherwise, Assyrian Events is not the seller of tickets or registrations. We are not responsible for ticket availability, ticket pricing, fees, registration, refunds, cancellations, ticket delivery, fraud occurring through third-party services, or disputes between users and organizers. Any transaction involving tickets or registration may be governed by separate terms established by the organizer or third-party provider.

12. DONATIONS

Assyrian Events may provide a mechanism for voluntary donations. Donations may be processed through third-party payment processors. Unless explicitly stated otherwise: a donation to Assyrian Events is not a purchase of a ticket, event registration, product, or service. Assyrian Events does not represent that donations are tax-deductible unless Assyrian Events expressly states that such treatment applies and is legally entitled to make that representation. Donation receipts may be provided for recordkeeping purposes. Users are responsible for determining their own tax treatment.

13. USER CONTENT

Users may submit: event listings, flyers, images, logos, descriptions, organization information, links, reviews or reports, messages, or other materials. You remain responsible for the content you submit.

14. REPRESENTATIONS REGARDING USER CONTENT

By submitting content, you represent and warrant that: you have the necessary rights, permissions, licenses, or authority to submit the content; the content does not knowingly contain false or misleading information; the content does not infringe another person's copyright, trademark, privacy, publicity, contractual, or other rights; the content does not violate applicable law; the content does not contain malicious code; you have authority to submit information on behalf of any organization you claim to represent; and you will promptly notify us if submitted information becomes materially inaccurate.

15. LICENSE TO ASSYRIAN EVENTS

By submitting content, you grant Assyrian Events a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, format, adapt, distribute, communicate, and make that content available through the Services and for reasonable promotion of the Services. This license is intended to allow us to operate the platform. You retain ownership of content you own.

16. COPYRIGHT AND INTELLECTUAL PROPERTY

Assyrian Events respects intellectual-property rights. If you believe content on the platform infringes your copyright or other rights, you may contact us with sufficient information to identify the allegedly infringing material and the basis for your claim. We may remove or restrict access to allegedly infringing material while a complaint is reviewed. Users who repeatedly submit infringing content may have their submission privileges restricted or terminated.

17. PROHIBITED CONDUCT

You may not: submit fraudulent events; submit knowingly false information; impersonate another person or organization; submit content without authorization; upload malicious software; attempt unauthorized access; circumvent security controls; interfere with website operation; scrape or harvest information in a manner that violates applicable law or these Terms; spam users; harass or threaten others; abuse reporting systems; use the platform for unlawful purposes; infringe intellectual-property rights; collect or misuse other users' personal information; attempt to manipulate rankings, listings, reviews, or visibility; use automated systems in a manner that unreasonably burdens the Services; or engage in conduct that creates an unreasonable security, legal, or operational risk.

18. REPORTING EVENTS

Users may report events that they believe contain: incorrect information, cancellation, spam, inappropriate content, duplicate information, or other concerns. A report does not guarantee removal. Assyrian Events may investigate and take whatever action it reasonably considers appropriate.

19. PLATFORM AVAILABILITY

We do not guarantee uninterrupted or error-free operation of the Services. The Services may be temporarily unavailable, modified, suspended, interrupted, subject to maintenance, affected by technical failures, affected by third-party service outages, or affected by circumstances outside our reasonable control.

20. SECURITY

We use reasonable measures designed to protect the Services. However, no system is completely secure. You acknowledge that internet communications and electronic systems involve inherent risks. You agree not to attempt to compromise the security of the Services.

21. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Services are provided "As Is," "As Available," and "With All Faults." Assyrian Events disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security, to the maximum extent permitted by law. We do not warrant that the Services or information provided through them will be accurate, complete, current, reliable, uninterrupted, error-free, or secure.

22. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Assyrian Events and its owners, operators, officers, directors, employees, contractors, agents, affiliates, licensors, service providers, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, business, goodwill, data, opportunity, or other intangible losses arising from or relating to: your use of the Services; your inability to use the Services; an event listed on the platform; an organizer; a venue; another user; third-party services; user-submitted content; event cancellations; ticket or registration issues; donations; security incidents; website interruption; or any other matter relating to the Services. To the maximum extent permitted by law, the total aggregate liability of Assyrian Events for claims arising out of or relating to the Services shall not exceed the greater of: (A) the amount you paid directly to Assyrian Events for the specific service giving rise to the claim during the twelve (12) months before the event giving rise to the claim; or (B) one hundred U.S. dollars (US $100). This limitation applies to the maximum extent permitted by law and does not apply to liability that cannot legally be limited or excluded.

23. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Assyrian Events and its owners, operators, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from and against claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: your use of the Services; your violation of these Terms; your submitted content; your event; your organization; your violation of another person's rights; your violation of applicable law; your fraud, negligence, or misconduct; or your dealings with other users, organizers, venues, or third parties. This provision does not require indemnification to the extent prohibited by applicable law.

24. RELEASE

To the maximum extent permitted by law, you release Assyrian Events and its owners, operators, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims arising out of or related to third-party events, organizers, venues, users, or other third parties. This release does not apply to liability that cannot legally be released.

25. ASSUMPTION OF RISK

To the extent permitted by law, you acknowledge that participating in or attending third-party events may involve risks that cannot be completely eliminated. You are responsible for evaluating whether an event is appropriate for you and for taking reasonable precautions.

26. INSURANCE

Assyrian Events does not represent that it provides insurance coverage for event organizers, attendees, venues, vendors, performers, or other participants. Event organizers are solely responsible for determining whether they need insurance coverage and for obtaining any required insurance.

27. REMOVAL AND TERMINATION

We may remove content, restrict access, suspend accounts, terminate access, or take other measures when we believe it is reasonably necessary to: enforce these Terms; protect users; protect the platform; address legal concerns; address security concerns; prevent fraud or abuse; respond to complaints; comply with law. We may do so with or without advance notice where permitted by law.

28. SURVIVAL

Provisions concerning intellectual property, user content licenses, disclaimers, limitations of liability, indemnification, releases, dispute resolution, and other provisions that by their nature should survive termination shall survive termination of these Terms.

29. GOVERNING LAW

These Terms shall be governed by the laws applicable to the jurisdiction selected by the legal owner of Assyrian Events, without regard to conflict-of-law principles, except where mandatory law provides otherwise. The final governing-law state, county, and venue should be inserted after the legal entity and operating location are finalized.

30. DISPUTE RESOLUTION

Before filing a legal action, you agree, to the extent permitted by law, to first provide Assyrian Events with written notice describing the dispute and a reasonable opportunity to resolve it. The final dispute-resolution procedure, including whether disputes will be handled through courts, arbitration, mediation, or another process, should be finalized with legal counsel and incorporated into the final published version. Nothing in this section prevents a party from seeking emergency or legally available injunctive relief where permitted by law.

31. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in effect.

32. NO WAIVER

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

33. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, constitute the agreement between you and Assyrian Events concerning your use of the Services, except where additional terms apply to specific services.

35. IMPORTANT LEGAL NOTICE

These Terms are intended to establish the respective responsibilities of Assyrian Events, event organizers, users, and third parties and to limit Assyrian Events' liability to the maximum extent permitted by applicable law. However, no contractual provision can eliminate liability that applicable law does not permit a party to disclaim, release, or limit. Assyrian Events should operate consistently with these Terms and should not make representations to users that conflict with them.
